				Preamble

  This license is intended to be similar in spirit to the GNU
General Public License (GNU GPL) as published by the Free Software
Foundation, Inc.  We believe that the GNU GPL has done more for
the advancement of free software than any other license, but that
it lacks sufficient motivation for programmers to devote their
entire career to the development of free software.

  The Non-Consultants' License (NCL) is based upon the original
intent of patents.  That is, by guaranteeing some returns on
research for a given period of time, individuals and corporations are
encouraged to spend time and money on research into new
technology.  But by then revoking the patent holder's rights after
a specified time has elapsed, monopolization is avoided.  The NCL
therefore gives you all of the freedoms and restrictions of the GNU
GPL but also adds another restriction:

  You MAY NOT distribute this work for profit as an executable, in 
  object form or as source code either on its own or as part of a 
  collection with other works without first establishing a distribution 
  agreement with the steward for the work.

To ensure that this restriction does not last permanently, another 
freedom is placed into this license:

  Two years after the release of this version of the work this license
  will expire and this version of the work will then be licensed to 
  you under the terms of the current version of the GNU General Public 
  License  or the GNU Library General Public License.

The NCL is intended for programmers who wish to make a living
out of writing free software but have no desire or ability to offer 
consulting services (especially when the work does not lend itself to 
the offering of such services).  If your intention is to earn income
from consulting then you should use the GNU GPL/LGPL instead.  The NCL 
will only increase your bookkeeping expenses and reduce the code-base 
from which you can work.  To encourage cooperation between all free 
software developers however you should preface the GNU GPL by stating:

	Under section 10 of the GNU GPL I hereby grant permission
	to use this code in works distributed under the terms
	of the Non-Consultants' License, as published by Bowerbird
	Computing, so long as the share of the royalties that would
	have been owing to me if this code were licensed under
	the NCL is donated to the Free Software Foundation instead.

One problem that could have arisen with charging royalties is the
restriction of code reuse.  If the individual author has control
over the royalties charged on his code then he could effectively
refuse to allow others to use his code by not agreeing to their
terms.  This obviously goes against the principles of free software,
so this license takes the responsibility of negotiating royalties
out of the hands of the individual and puts them into the hands of the
collective.  This license serves as both a license for the licensee
and as a constitution for the authors.  This license forms a new
form of software `corporation' that is in fact a voluntary
collective of authors.  To avoid confusion, this form of software 
should be referred to as "Open Development Software".

v.     "Author" - Any legal entity that contributes to the source code for

viii.  "Steward" - The legal entity that has been elected to this
position by the authors of the work in accordance with the conditions
for such elections set out in this license.

viiii. "Version Of The Work" - Any particular state of the work
in its evolution that has been deemed by the steward to be suitable 
for release to parties other than the Authors.  Merely releasing a 
particular state of the work in its evolution to other parties does 
not constitute a new version of the work.

b. ACTIVITIES
This license applies only to copying, distribution and modification
of the work.  It does not cover the offering of consultancy services
for the work or the offering of warranty protection for the work.  It
does not cover the use to which the work is put or the output of the
work. It does not cover other works which may be distributed
with the work.

Two years after the release of this version of the work this license
will expire and this version of the work will then be licensed to 
you under the terms of the current version of the GNU General Public

use the terms "Non-Consultants' License", "NCL" or any other term

3 DERIVATIVE WORKS

4 STEWARDSHIP

a. RULES FOR VOTING

All ballots held by the authors shall be held as follows:

i.     All authors shall be given one weeks notice of the ballot, 
       during which time candidates for election to the position of 
       steward or propositions may be nominated.  A candidate may 
       nominate himself. 
ii.    The voting period shall last for seven days. 
iii.   The preferential voting system shall be used for all votes.  That
       is, the voters have to number each candidate/proposition in order 
       of preference.  If all candidates/propositions are not numbered 
       then the vote is informal.  Upon the initial tally count the 
       candidate/proposition with the least number of first preferences 
       shall be eliminated and the votes cast for that candidate/proposition
       will be redistributed based on second preferences.  This process of 
       elimination will continue until one candidate/proposition
       has the majority of votes.
iiii.  All authors shall have one vote in the election, regardless of 
       contribution to the work.  
v.     The result shall be valid regardless of the proportion of authors 
       that cast a valid vote or the proportion who cast a any vote at all.
vi.    Any author may initiate a vote by gaining the support of at least 
       one quarter of the authors for holding the vote.  
vii.   The author who initiated the vote shall be the returning officer 
       for the vote.  
viii.  The returning officer for the vote may not be nominated for the 
       position of steward.
viiii. The form of returning votes shall not be by any means that will
       not allow one or more of the authors to cast a vote within the
       voting period.

b. POWERS OF THE STEWARD

The steward for the work shall be the entity elected to the position
by the authors under the rules for holding ballots in section 4.a.
The steward shall have the following powers:

i.    The steward shall determine the release date of the next version of
      the work.  The authors may overrule the decision of the steward
      by holding a ballot under the rules of section 4.a.
ii.   The steward shall conduct all negotiations under section 2.b of
      this license and may give authorization to distribute the work
      under section 2.b without obtaining the consent of the authors.
      The authors MAY NOT overrule the decision of the steward.
iii.  The steward shall have the power to determine the way in which
      any money raised under power ii will be distributed among the
      authors and any other parties that he sees fit to include.  The
      Authors may overrule the decision of the steward by holding a
      ballot under the rules of section 4.a.
iiii. The steward may have any other powers granted to him by the authors
      by conducting a ballot under the rules of section 4.a.  The authors 
      may also rescind such powers by holding another ballot in the same 
      manner.

The authors may not rescind powers i, ii and iii from the steward, but
they may elect a new steward at any time.  The authors may also create 
any other position with the powers of their choosing (But not so as to 
conflict with the powers of the steward) by holding a ballot under the 
rules of section 4.a.  They may also abolish such positions or rescind 
powers of such positions by holding a ballot under the rules of 
section 4.a.

5 INTEGRITY OF FREE SOFTWARE

a. INTELLECTUAL PROPERTY CLAIMS AND LEGISLATION AFFECTING THE WORK

If for any reason you are not legally permitted to distribute this
work under the terms of this license (including the ability to distribute
it under the terms of the GNU GPL or LGPL after this license expires) 
then you may not distribute it at all.  If this restriction only applies 
to a particular geographical region then you may not distribute it within 
that region or, if it is not possible for you to restrict its distribution 
within that region, you may disclaim all distribution within that 
region - It is not the responsibility of the licensee to enforce this 
license with third parties.

b. THIS LICENSE

When distributing the work you may not impose new terms on third parties
or remove terms specified in this license.  If you fail to comply with
the terms of this license then your rights under this license will
